This agreement has been issued pursuant to the Regulation on Procedures and Principles of Distance Contracts, published in the Official Gazette dated 13.06.2003 and numbered 25137, which requires a contract for sales made over the internet. The provisions are outlined below:


ARTICLE 1 – SUBJECT

This agreement covers the rights and obligations of the SELLER and the BUYER in accordance with the provisions of the Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale and delivery of the product whose features and sales price are specified below.


ARTICLE 2.1 – SELLER INFORMATION

ARTICLE 2.2 – BUYER INFORMATION

The person who registers as a customer on oligatto.com.
The contact and address details provided during membership or at the time of order are taken as the basis.


ARTICLE 3 – PRODUCT INFORMATION

The type, quantity, brand/model, color, price, payment method, and other details of the product/service are based on the information at the time the order is finalized.


ARTICLE 4 – GENERAL TERMS

4.1 – The BUYER acknowledges that they have read and understood all preliminary information related to the product(s), including essential features, sales price, and delivery terms, and has provided the required confirmation electronically.

4.2 – The product(s) subject to this agreement shall be delivered to the BUYER or the person/entity at the specified address within a maximum legal period of 30 days. This period may be extended up to 10 additional days with prior notice to the BUYER.

4.3 – If the product is to be delivered to a third party and that party refuses delivery, the SELLER cannot be held responsible.

4.4 – The SELLER is responsible for ensuring that the product is delivered complete, undamaged, and in accordance with the specifications stated in the order, along with warranty documents and user manuals, if applicable.

4.5 – The product shall be delivered only after full payment is made by the BUYER via the selected payment method. If payment is not completed or is canceled in the bank records, the SELLER is deemed to be released from the delivery obligation.

4.6 – If the BUYER’s credit card is fraudulently used by unauthorized parties after delivery, and the bank does not pay the amount to the SELLER, the BUYER must return the delivered product to the SELLER within 3 days. Return shipping costs are borne by the BUYER.

4.7 – In case of force majeure (e.g. adverse weather, transportation disruptions), the SELLER must inform the BUYER if the product cannot be delivered on time. The BUYER may then choose to cancel the order, replace it with an equivalent product, or postpone delivery until the issue is resolved. If the order is canceled, the payment is refunded within 10 days.

4.8 – Defective products, whether or not sold with a warranty, may be returned to the SELLER for repair under warranty terms. Return shipping costs in this case are covered by the SELLER.

4.9 – This agreement becomes valid once it is sent to the BUYER by fax or email by the SELLER.


ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within seven (7) days from the delivery of the product to them or to the designated recipient.
To exercise this right, the BUYER must notify the SELLER via fax, email, or phone within this period, and the product must be unused.

For the withdrawal to be valid, the BUYER must return the invoice and delivery receipt with the product. Once received, the SELLER will refund the product price within 7 days.
If the invoice is not returned, VAT and other applicable charges cannot be refunded. The return shipping cost due to withdrawal will be covered by the SELLER.

Products that cannot be returned due to their nature (e.g. perishables, single-use items, custom-made products, or software that can be copied) are excluded from the right of withdrawal.


OTHER PROVISIONS

If the payment is made with a credit or debit card, and the card is used unlawfully by unauthorized persons without the consumer’s consent, the consumer may request cancellation of the transaction.
In such a case, the card issuer must refund the payment within 10 days of being informed.

In case of default, the debtor agrees to compensate the creditor for any damages or losses incurred due to the delay.

In the enforcement of this agreement, Consumer Arbitration Committees and Consumer Courts in the SELLER’s or BUYER’s place of residence, within the limits set by the Ministry of Industry and Trade, shall have jurisdiction.
